Last updated: March 7, 2025
This Privacy Policy explains how Radani Auto (“we”, “us” or “our”) collects, uses, discloses and protects personal information when you visit radaniauto.ca (the “Website”), contact us, visit our dealership, buy a vehicle from us, sell or trade in a vehicle to us, or otherwise deal with us.
We are located in British Columbia, Canada. We handle personal information in line with the British Columbia Personal Information Protection Act (PIPA) and, where it applies, the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada’s Anti-Spam Legislation (CASL).
By using the Website or giving us your personal information, you agree to the collection, use and disclosure of your information as described in this Policy.
1. What Personal Information Means
“Personal information” means information about an identifiable individual. It does not include business contact information that is used only to communicate with someone about their work, or information that has been made anonymous so it can no longer identify a person.
2. Information We Collect
2.1 Information you give us
We collect information you choose to give us, including when you:
- Contact us or ask about a vehicle: your name, email address, phone number and the content of your message.
- Subscribe to our updates: your email address and, if provided, your name.
- Book a viewing or test drive: your name, contact details, and a copy of your driver’s licence so we can confirm you are licensed to drive.
- Buy a vehicle from us: your full name, address, date of birth, driver’s licence details, contact details, insurance details, payment details, and any other information required to complete the bill of sale, transfer ownership and register the vehicle with ICBC.
- Sell or trade in a vehicle to us: your name, contact details, proof of identity, proof of ownership, vehicle details (such as the VIN, make, model, year, odometer reading, condition and photos), lien and loan payout details, and payment details needed to pay you.
- Apply for financing (if offered): the information requested on the credit application, such as your employment, income, housing and existing debts. We will only share this with lenders and credit bureaus with your consent (see Section 4.3).
We do not require your Social Insurance Number (SIN) to sell you a vehicle or to buy one from you. A lender may ask for it as part of a credit application. Giving your SIN to a lender is your choice unless the lender or the law requires it.
2.2 Information collected automatically
When you use the Website, we and our service providers may automatically collect:
- your IP address, browser type, device type and operating system;
- the pages you view, the links you click, the date and time of your visit, and the website that referred you;
- general location based on your IP address (city or region level, not your exact location).
This information is collected through cookies and similar technologies (see Section 7).
2.3 Information from third parties
We may receive information about you from:
- lenders, if you apply for financing;
- vehicle history and lien search providers (such as CARFAX Canada and the BC Personal Property Registry) when we check a vehicle you are selling or trading in;
- ICBC and insurers, when needed to complete a vehicle transfer.
3. How We Use Your Information
We use personal information only for purposes a reasonable person would consider appropriate, including to:
- answer your questions and respond to vehicle inquiries;
- arrange viewings and test drives;
- prepare and complete vehicle sale, purchase and trade-in agreements;
- transfer and register vehicles, and confirm ownership and liens;
- process payments and pay you for a vehicle you sell to us;
- help you apply for financing, if you ask us to;
- send you updates and offers, but only if you have agreed to receive them;
- operate, secure and improve the Website;
- prevent fraud and protect our business, customers and vehicles;
- meet our legal, regulatory, tax and record-keeping obligations, including those that apply to licensed motor dealers in British Columbia.
If we want to use your information for a new purpose, we will tell you and, where required, ask for your consent first.
4. How We Share Your Information
We do not sell or rent your personal information.
We share personal information only in the following cases:
4.1 Service providers
We use trusted third parties to help us run our business, such as website hosting, email delivery, newsletter services, payment processing and IT support. They may only use your information to provide services to us, and they must protect it.
4.2 Government and regulators
We share information with ICBC and other government bodies when needed to transfer and register vehicles, and with the Vehicle Sales Authority of British Columbia, the Canada Revenue Agency and other authorities when the law requires it.
4.3 Lenders and credit bureaus
If you ask us to help you get financing, we will share your credit application with one or more lenders, and those lenders may obtain your credit report from a credit bureau. We will only do this with your consent. Each lender handles your information under its own privacy policy.
4.4 Legal reasons
We may disclose information if required or allowed by law, such as to respond to a court order, a valid legal request, or to investigate fraud or protect someone’s safety.
4.5 Business transfer
If our business is sold, merged or reorganized, personal information may be transferred to the new owner, who must use it only for the purposes described in this Policy.
5. Storage Outside Canada
Some of our service providers (for example, website, email and newsletter providers) may store or process information outside Canada, including in the United States. When this happens, your information may be subject to the laws of that country and may be accessed by its courts, police or government. We take reasonable steps to make sure these providers protect your information to a standard similar to ours.
6. Your Consent
We collect, use and disclose personal information with your consent, except where the law allows otherwise. Consent may be express (for example, ticking a box or signing a form) or implied (for example, when you send us your contact details and ask us to call you back).
You may withdraw your consent at any time by contacting us, subject to legal or contract limits and reasonable notice. If you withdraw consent, we may not be able to provide some services, such as completing a sale or financing application.
7. Cookies and Tracking Technologies
Cookies are small files stored on your device. We use them to:
- make the Website work properly (for example, remembering your settings and keeping forms secure);
- understand how visitors use the Website so we can improve it, where we use analytics tools for this purpose.
Some features on the Website are provided by third parties and may set their own cookies, including:
- Google Maps, which shows our location;
- Gravatar, which displays profile images;
- Social media sharing links (Facebook and X), and links to our Instagram and TikTok pages;
- CARFAX Canada, when you open a vehicle history report link.
These third parties handle information under their own privacy policies. You can block or delete cookies in your browser settings. If you do, some parts of the Website may not work properly.
8. Email Updates and Marketing
We will only send you marketing emails or texts if you have agreed to receive them or if CASL otherwise allows it (for example, after you have made a purchase or inquiry with us). Every marketing message will identify us and include a simple way to unsubscribe. You can unsubscribe at any time using the link in the message or by contacting us. We will process your request within 10 business days.
We may still send you messages about a transaction you started, such as confirming an appointment or a sale.
9. How We Protect Your Information
We use reasonable physical, administrative and technical safeguards to protect personal information from loss, theft and unauthorized access, use or disclosure. These include locked storage for paper records, password-protected systems, secure (HTTPS) connections on the Website, and limiting access to staff who need it for their work.
No method of sending or storing information is completely secure. Please do not send sensitive information, such as driver’s licence images, banking details or your SIN, through the Website contact form or by regular email. Ask us for a secure way to provide it.
If a privacy breach happens that creates a real risk of significant harm to you, we will notify you and the relevant privacy regulator as required by law.
10. How Long We Keep Your Information
We keep personal information only as long as needed for the purposes it was collected for, and as long as required by law. Records of vehicle sales and purchases are kept for the periods required under British Columbia motor dealer, tax and other laws. If we use your information to make a decision that directly affects you, we keep it for at least one year after that decision so you have a fair chance to request access to it. When we no longer need information, we securely destroy it or make it anonymous.
11. Your Rights
Subject to the limits set by law, you have the right to:
- ask whether we hold personal information about you and request a copy of it;
- ask how your information has been used and to whom it has been disclosed;
- ask us to correct information that is wrong or incomplete;
- withdraw your consent, as described in Section 6.
To make a request, contact our Privacy Officer in writing (see Section 14). We may need to confirm your identity before responding. We will respond within 30 days, or within any longer period allowed by law, in which case we will tell you why. Access is free in most cases. If a fee applies, we will tell you the amount before we process your request. In some cases, the law allows or requires us to refuse access, for example if the information would reveal another person’s personal information. If we refuse, we will explain why.
12. Children’s Privacy
The Website and our services are intended for adults. We do not knowingly collect personal information from anyone under 19 years of age, which is the age of majority in British Columbia. If you believe a minor has given us personal information, please contact us and we will delete it.
13. Third-Party Websites
The Website contains links to websites we do not control, such as CARFAX Canada, Google Maps, Instagram and TikTok. This Policy does not apply to those websites. Please read their privacy policies before giving them your information.
