These Terms and Conditions (“Terms”) apply to your use of radaniauto.ca (the “Website”), which is operated by Radani Auto (“we”, “us” or “our”), 20290 Logan Ave, Langley, BC V3A 4L6.
By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
1. Who May Use the Website
You may use the Website to browse our inventory, learn about our services and contact us. To enter into any agreement with us, such as buying, selling or trading in a vehicle, you must be at least 19 years old (the age of majority in British Columbia) and legally able to enter into a binding contract.
2. The Website Is for Information Only
The Website is a source of general information about our vehicles and services. No vehicle can be bought, reserved or sold through the Website itself. Submitting a form, sending a message or contacting us about a vehicle does not create a contract, reserve the vehicle or guarantee that it is available.
A vehicle purchase, sale or trade-in becomes binding only when you and Radani Auto sign a written agreement. That written agreement, together with any rights you have under British Columbia law, governs the transaction. If anything in these Terms conflicts with a signed agreement, the signed agreement applies.
3. Vehicle Listings
3.1 Accuracy
We work hard to make sure our listings are accurate, including the price, year, make, model, trim, odometer reading, equipment, specifications and photos. However, listings may sometimes contain errors or may not be updated right away. When we find an error, we will correct it promptly.
Before you sign any agreement, please inspect the vehicle and confirm the details that matter to you, such as the odometer reading, equipment and condition. All required disclosures about a vehicle, including its history, prior use and any damage that must be declared, will be given to you in writing before you sign.
3.2 Photos
Photos are for illustration. Some photos may be stock images or may show the same model with different colours or equipment. The written sales agreement and the vehicle itself determine what you are buying.
3.3 Availability
Vehicles are offered subject to prior sale. A vehicle shown on the Website may already be sold or on hold. Please contact us to confirm availability before visiting.
4. Prices, Fees and Taxes
As required by British Columbia law, the advertised price of each vehicle is the total price. It includes all dealer fees, such as documentation, administration, inspection and pre-delivery fees, and any transportation charges. The only amounts added to the advertised price are GST, PST and other government taxes and levies, plus any optional products or services you choose to buy, such as extended warranties.
Nothing in these Terms limits any obligation we have under British Columbia law to honour an advertised price.
If you finance a vehicle, the full cost of borrowing, including the interest rate and any fees, will be set out in your written financing agreement.
5. Deposits
We do not take deposits through the Website. If you choose to leave a deposit at our dealership, we will give you the deposit terms in writing before you pay, including how long the vehicle will be held, whether the deposit is refundable, and under what conditions it will be refunded.
6. No Cooling-Off Period
British Columbia law does not give buyers a general right to cancel a vehicle purchase after signing the sales agreement. Please read the full agreement carefully and ask us any questions before you sign. Any return or exchange rights will apply only if they are stated in writing in your signed agreement or are given to you by law.
7. Selling or Trading In Your Vehicle
Any value or estimate we give you for your vehicle by phone, email, message or through the Website is an estimate only. It is not a binding offer. A final offer depends on:
- an in-person inspection of the vehicle;
- proof that you own the vehicle and have the right to sell it;
- a lien search and the payout of any loan or lien on the vehicle;
- a vehicle history check;
- the vehicle’s condition, history and odometer reading matching the information you gave us.
You must give us complete and truthful information about your vehicle, including any accident damage, prior use (such as rental, taxi or police use), and any lien or money owing on it.
8. Vehicle History Reports
Some listings include a link to a vehicle history report from a third party, such as CARFAX Canada. These reports are prepared by those third parties and are provided for your convenience. We are not responsible for errors in third-party reports. This does not reduce any duty we have under British Columbia law to disclose information about a vehicle to you.
9. Your Use of the Website
When using the Website, you agree not to:
- give false information or pretend to be someone else;
- use the Website for any unlawful or fraudulent purpose;
- send spam, viruses or any harmful code;
- try to gain unauthorized access to the Website, our systems or other users’ information;
- copy, scrape or collect content or data from the Website by automated means without our written permission;
- interfere with the normal operation or security of the Website.
We may block access to the Website for anyone who breaks these Terms.
10. Intellectual Property
The Website and its content, including text, photos, graphics, logos and the Radani Auto name and logo, belong to Radani Auto or are used with permission. They are protected by Canadian and international copyright and trademark laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, publish or use any content for any other purpose without our written permission.
11. Third-Party Links and Services
The Website includes links to and features from third parties, such as CARFAX Canada, Google Maps, Instagram, TikTok, Facebook and X. We do not control these third parties and are not responsible for their content, services or privacy practices. Your use of them is subject to their own terms and policies.
12. Website Availability
We try to keep the Website available and secure, but we do not promise that it will always be available, uninterrupted or free of errors or viruses. We may change, suspend or remove any part of the Website at any time without notice.
13. Disclaimer
The Website and its content are provided “as is” and “as available” for general information. To the fullest extent permitted by law, we make no promises or warranties about the Website itself.
This section applies only to the Website. It does not apply to any vehicle you buy from us. Your rights about a vehicle purchase are set out in your written sales agreement and in British Columbia law.
14. Limitation of Liability
To the fullest extent permitted by law, Radani Auto, its owners, employees and agents are not liable for any indirect, incidental, special or consequential loss or damage, or for any loss of profit, data or opportunity, that arises from your use of, or inability to use, the Website or from relying on its content.
15. Indemnity
You agree to cover any loss, damage, cost or claim (including reasonable legal fees) that Radani Auto suffers because you broke these Terms or misused the Website.
16. Your Legal Rights Are Protected
Nothing in these Terms removes or limits any right you have as a consumer that cannot legally be removed or limited. This includes your rights under the British Columbia Business Practices and Consumer Protection Act, the Sale of Goods Act, the Motor Dealer Act and their regulations. If you have a concern about a vehicle transaction that we cannot resolve, you may contact the Vehicle Sales Authority of British Columbia at www.vsabc.ca.
17. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply in British Columbia. Any dispute about these Terms or the Website will be dealt with by the courts or tribunals of British Columbia, including the Civil Resolution Tribunal where it has jurisdiction.
18. Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed only as much as needed, and the rest of these Terms will remain in full effect.
19. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Website after a change means you accept the updated Terms. Changes do not affect any agreement you have already signed with us.
